Welcome to ClaimMyBag.com ("we," "us," or "our"). We provide a software service (the "Service") designed to assist travelers in documenting, managing, and generating claim letters for mishandled (delayed, damaged, or lost) baggage claims with airlines.

By accessing or using our website and services, you ("User," "you") agree to be bound by these Terms and Conditions (the "Terms") and our Privacy Policy. Please read them carefully.

IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE OUR SERVICES.

1. Description of Service

ClaimMyBag.com is a self-help software tool. Our Service allows you to:

  • Organize and store relevant information regarding your baggage claim (such as flight details, baggage descriptions, and photos).
  • Upload and manage supporting documents (such as receipts, baggage tags, and your Property Irregularity Report).
  • Use our templates to generate formal claim letters and communications ("Claim Documents") to be sent by you to the relevant airline.
  • Access general information and resources related to the airline baggage claim process.

2. We Are Not a Law Firm and Provide No Legal Advice

This is the most important term. You acknowledge and agree that:

  • No Legal Advice: ClaimMyBag.com is not a law firm and does not provide legal advice, legal representation, or legal services of any kind.
  • No Attorney-Client Relationship: Your use of our Service does not create an attorney-client relationship between you and ClaimMyBag.com or any of its employees or affiliates.
  • Self-Help Tool: Our Service provides templates and information for informational purposes only. These are not a substitute for the advice of a qualified attorney. The law is complex and changes often, and airline policies vary. We do not guarantee that the information provided is complete, accurate, or up-to-date.

3. Your Responsibilities as a User

To use our Service, you must agree to the following:

  • Age: You must be at least 18 years old to use the Service.
  • Accurate Information: You agree to provide true, accurate, and complete information as prompted by the Service. The effectiveness of the generated Claim Documents depends entirely on the accuracy of the information you provide.
  • The Property Irregularity Report (PIR): You acknowledge that our Service is not a substitute for filing the initial, mandatory report with your airline. You are solely responsible for:
    1. Locating the airline's baggage service office at the arrival airport.
    2. Filing a Property Irregularity Report (PIR) (or equivalent document) with the airline before leaving the airport.
    3. Obtaining and safely storing the unique file reference number provided by the airline.
  • Our Service is the Second Step: You understand that our Service is designed to be used after you have completed the in-person PIR filing and received your file reference number. Failure to file a PIR in a timely manner may result in the airline denying your claim, regardless of any documents generated by our Service.
  • Sending the Claim: You are solely responsible for sending the generated Claim Documents to the correct airline department, for following up with the airline, and for meeting all airline-specific deadlines.

4. User Accounts

You may need to create an account to use our Service. You are responsible for safeguarding your account password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

5. User-Provided Content

Our Service allows you to upload, store, and manage your personal information, including photos, receipts, and claim details ("User Content").

  • Ownership: You retain all ownership rights to your User Content.
  • License to Us: By uploading User Content, you grant us a limited, worldwide, non-exclusive, royalty-free license to use, process, and transmit this content solely for the purpose of providing the Service to you (e.g., to store your photos and to populate your information into a claim letter template).
  • Responsibility: You are solely responsible for your User Content and for having the necessary rights to upload it.

6. Intellectual Property

All content on our Service that is not User Content, including the website design, text, graphics, logos, and software templates (the "ClaimMyBag Content"), is the exclusive property of ClaimMyBag.com and is protected by copyright and other intellectual property laws. You may not use, copy, modify, or distribute any ClaimMyBag Content without our express written permission.

7. Prohibited Uses

You agree not to use the Service:

  • For any fraudulent or unlawful purpose.
  • To submit false, misleading, or inaccurate information to an airline.
  • To impersonate any person or entity.
  • To reverse-engineer, decompile, or otherwise attempt to discover the source code of our software.

8. Disclaimers and No Guarantees

  • NO GUARANTEE OF OUTCOME: We do not participate in your claim and have no control over the airline's decision-making process. We do not promise, guarantee, or warrant that your claim will be successful, that you will receive any compensation, or that the airline will respond to your claim. The airline's decision is final and binding, subject to your right to escalate the claim (e.g., to the DOT or small claims court), which you must do on your own.
  • SERVICE "AS IS": The Service is provided "AS IS" and "AS AVAILABLE," without any warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.
  • NO INFORMATION WARRANTY: We do not warrant the accuracy, completeness, or timeliness of any informational content provided through the Service (such as blog posts, guides, or liability limit data). Airline policies and federal regulations (like DOT liability limits) can change.

9. Limitation of Liability

To the fullest extent permitted by law, ClaimMyBag.com and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, or for any financial losses you may incur, including the loss of your baggage claim, arising from:

  • Your use of, or inability to use, the Service.
  • Any denial of your claim by an airline.
  • Your failure to file a PIR or meet an airline's deadline.
  • Any reliance on information provided by the Service.
  • Any unauthorized access to or use of your account or User Content.

Our total liability to you for any and all claims related to the Service shall not exceed the amount you paid us, if any, for the Service.

10. Indemnification

You agree to defend, indemnify, and hold harmless ClaimMyBag.com from and against any claims, damages, losses, liabilities, costs, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your submission of false or fraudulent information.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which details how we collect, use, and protect your personal information. You must read and agree to the Privacy Policy to use our Service.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
